Roger Castle

Our practice is dedicated to representing individuals and families who have suffered serious personal injuries or the loss of a family member.

We have successfully represented those suffering from a physical injury or death occurring in a wide  variety of circumstances and a tragic range of causes, including:

  • Auto & Motorcycle Accidents
  • Medical Malpractice
  • Defective & Dangerous Products
  • Skiing, Snowboard, Snowmobile Accidents
  • Construction Site injuries

Physical injuries resulting from these causes can be difficult and often catastrophic. We aggressively investigate, negotiate, litigate, and conduct jury trials and arbitrations of your meritorious claims to secure you much needed compensation for medical expenses, lost wages and earning capacity, severe scarring and disfigurement. physical impairment and disability, rehabilitation expenses, grief and emotional damages, a spouse's loss of consortium, and, in egregious cases, punitive damages.

We have successfully represented clients in injury and wrongful death cases involving some of the most powerful manufacturers and service providers in America, including:

  • Ford
  • Honda
  • U-Haul
  • Hertz
  • Union Pacific Railroad
  • General Electric
  • Michelin
  • Goodyear
  • Firestone
  • Kaiser Permanente
  • McGraw-Hill Broadcasting Co.

Locally, we have of course also prosecuted hundreds of cases against businesses and utility companies, cities and counties, the State of Colorado and its departments, various governmental highway and protection Districts, and universities.  We have successfully handled numerous Federal Tort Claims Act cases against the United States Government and a variety of its departments, including the U.S. Postal Service.

Our cases have been up against virtually every major insurance company in the United States.

After successful jury verdicts and other resolutions in the trial courts, Roger has personally argued many appeals in the Colorado Court of Appeals, the Colorado Supreme Court, and the U.S. Court of Appeals. Many of these appeals resulted in landmark court decisions in the personal injury law field.

In addition to handling hundreds of the most common types of motor vehicle collisions, we also have very substantial experience representing clients injured in: Road Rage incidents; Bus crashes; taxicab accidents; Bicycle and Pedestrian collisions; truck dock accidents; Dram Shop cases (against a bar, restaurant or alcohol server for serving an already obviously intoxicated driver); defective railroad tracks and dangerous Railroad crossings; Snowplow crashes; drunk driving incidents; Jeep-4WD, ATV (all terrain vehicle) and other off-road vehicle crashes; road construction defects and construction barrier dangers; the defective design and negligent maintenance of highways, streets, curbs, sidewalks and intersections.

In the "products liability" area, we have had the privilege of helping many victims of bad products that were dangerously designed, defectively manufactured, or missing safety features, including:

motor vehicles, heavy equipment, child seat belts, backhoes, front-end loaders, forklifts, trenchers, Bobcats, seatback and car trunk collapses, metal or fabric machine presses (causing amputations), dangerous motorcycle designs including exploding gas tanks and leg protection problems, dangerous playground and exercise or weight-lifting equipment, equipment control malfunctions, electrical switch defects and malfunctions, defective or bad tires, dangerous wheels or rims (e.g. tire-rim mismatches), and throttle linkage malfunctions (e.g."stuck throttle").

In addition to vehicle accident and defective product litigation, we also have over 3 decades of experience representing victims of medical errors and malpractice. When the people you relied upon to provide you with medical care are negligent and you suffer serious and permanent injuries, we can help you carefully evaluate your situation and carefully decide on the best course of any action you might consider. Our cases involving medical or nursing errors have included:

failure to diagnose cancer (e.g., colon, uterine, skin) or pulmonary embolism, failure to remove all surgical sponges and surgical instruments before closing the surgery and sending the patient home, failure to diagnose and repair obvious bone fractures, operating on the wrong limb or at the wrong level of back/spine vertebrae, gross anesthesia errors resulting in brain damage or death, failure to timely treat cancer or pulmonary embolism, nursing home neglect, hospital falls due to a negligent lack of supervision, negligent bowel perforations and punctures when performing unrelated surgery---resulting in severe or deadly infections, negligently cutting nerves and blood vessels that should not have been effected, tight cast problems (resulting in loss of limb or the death of muscle tissue), chemical or laser burns, birth trauma to baby and mother from negligently conducted delivery, incontinence of bowel or urine due to episiotomy and other causes, and performing surgery without the patient's consent.

In the snow and winter sports field, for 30+ years we have represented people injured in ski and snowboard incidents, including: many collisions caused by reckless or out-of-control skiers and snowboarders, ski lift failures, lift operator errors, snowmobile collisions, and the negligent design and maintenance of ski slopes and ski area obstructions.

In the area of "premises liability" or construction site injuries, we have successfully pursued claims involving: building or construction collapses, natural gas explosions, elevator crashes, construction site falls, stairway collapses, and dangerous or poorly maintained walkways and parking lots.

We have prosecuted claims involving  airplane crashes, crop-dusting errors, gun discharges, paint-ball injuries, and sports injuries caused by someone else's gross negligence.

We have also  represented many clients who suffered a non-physical injury, such as financial harm, or harm to their business or reputation. We successfully represented clients in some of the landmark Colorado cases against the media for defamation, invasion of privacy, slander, and libel.

In the Insurance or "bad faith" field, we have helped hundreds of clients obtain the reasonable compensation that had been denied by their own auto insurance for "UM" (uninsured motorist) or "UIM" (underinsured motorist) benefits. We also have handled numerous insurance "coverage" cases where we helped individuals and businesses obtain the auto-life-health-disability-liability insurance coverage and benefits that their insurance company was wrongly refusing to pay------even though the client had clearly paid for it.

We also have considerable experience representing clients that received less than professional and competent service from their prior attorney and are considering a legal malpractice claim, including claims for the negligent drafting of wills, trusts, or contracts; failure to timely file claims within the statute of limitations, and neglect of the case.

Finally, but sadly, we have been privileged to represent children and babies (and their parents) in cases where they suffered injuries, brain damage, and even death from the neglect or behavior of babysitters or daycare establishments, including "shaken baby" cases.

Regardless of the type of injury you have suffered or the circumstances under which you suffered it, if you were injured because of the fault of another, we will work tirelessly to evaluate your case, protect your rights, and negotiate and try your claims.
